Austin ADU Permit: do you likely need a permit?
Austin treats an ADU as a regulated additional dwelling unit; expect zoning verification, unique addressing, residential plan review, and trade permits where applicable.
What the official sources say
Austin defines an Additional Dwelling Unit as a separate dwelling unit on the same property as a single-family home and says a structure or portion of a structure is a dwelling unit if it contains habitable space, a full bathroom, and a sink or dishwasher outside a full bathroom. Austin says ADUs may be built only when minimum requirements are met, including zoning and lot-area checks, unique addressing, and a residential building permit path.
Likely permit path
- Zoning/property verification before design or application.
- New address or building number before submitting the residential building permit application.
- Residential plan review and building permit, plus trade permits for electrical, plumbing, mechanical, gas, or HVAC work.
Watch-outs
- Austin calls out deed restrictions and restrictive covenants as property-specific issues the applicant must verify.
- Dwelling-unit status can be triggered by bathroom plus independent sink/dishwasher features.
- Fire separation, technical code spacing, utility, internal access, occupancy, and addressing requirements can change the path.
Documents to gather
- Property zoning, lot size, survey or site plan, and proposed ADU location.
- Floor plans showing habitable space, bathroom, kitchen/sink features, entrances, and utility scope.
- Address confirmation, trade scope, and any deed restriction or HOA information.
Questions to ask before applying
- Is this an ADU, JADU, attached ADU, detached ADU, garage conversion, or non-rental habitable-space conversion?
- What zoning district, overlays, coastal/historic/flood/fire conditions, HOA limits, or deed restrictions apply to the property?
- Will the unit include independent living, sleeping, cooking, and sanitation facilities?
- What building, zoning, trade, utility, addressing, parking, inspection, and certificate-of-occupancy steps apply before occupancy or rental use?
